Huntsville, Ala. (WAFF) – A Huntsville City Council member who allegedly shoplifted from several Huntsville Walmarts between November 2022 and February 2023 has asked to suppress his statements.
Devin Keith was arrested 31 times for allegedly stealing from three different Walmarts. Documents obtained by WAFF allege Keith stole more than $300 worth of merchandise from the Walmart located at 6140 University Drive.
Keith’s legal team filed a motion Saturday to strike the statement. This petition alleges that any and all evidence obtained, directly or indirectly, was the result of an illegal search and/or seizure in violation of the Fourth and Fourteenth Amendments to the United States Constitution.
The motion also alleges that the search warrants were executed without probable cause and without Keith’s consent, and that the arrest occurred at a time when the defendant was not read his Miranda Rights.
The petition asks that any statements be suppressed because the state allegedly obtained them through illegal means.
